Terms and conditions of sale for products sold on jeudi13.ch/e-shop

ARTICLE 1 - SCOPE OF APPLICATION

The present terms and conditions govern sales by the company Jeudi 13 Sàrl, whose registered office is located at Espace des Remparts 13, 1950 Sion, Switzerland, and which offers services for the sale of ready-to-wear clothing and accessories for women.

In store: Espace des Remparts 13, 1950 Sion, Switzerland during our opening hours from 10:00 to 18:30 Monday to Friday and from 10:00 to 17:00 on Saturday.

Contractual information is presented in French and will be confirmed at the latest when your order is validated.
The company Jeudi 13 Sàrl reserves the right not to register a payment and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

ARTICLE 3 - ORDER VALIDATION

All orders placed on the site jeudi13.ch/e-shop imply acceptance of the following terms and conditions of sale. Any order confirmation implies your full acceptance of the general terms and conditions of sale, without exception or reservation.

All data supplied and the recorded confirmation shall constitute proof of the transaction. You declare that you are fully aware of this.

Confirmation of the order will constitute signature and acceptance of the operations carried out.

A summary of your order information and these terms and conditions will be sent to you in PDF format via the e-mail address used to confirm your order.

ARTICLE 4 - PRICE

The prices of our products are indicated in Swiss francs (CHF), inclusive of all taxes (VAT and other taxes applicable on the day of the order), unless otherwise indicated and exclusive of processing and shipping costs.

All orders are payable in Swiss francs and are placed in Switzerland.

Jeudi 13 Sàrl reserves the right to modify its prices at any time, but the price will be invoiced on the basis of the price list in force at the time the order is validated and subject to availability.

Products remain the property of Jeudi 13 Sàrl until full payment has been received.

ARTICLE 5 - DELIVERY

Products are delivered to the Swiss address indicated during the order process, within the time indicated on the order confirmation page.

In the event of a delay in shipment, an e-mail will be sent to inform you of any consequences on the delivery time indicated.

Jeudi 13 Sàrl cannot be held responsible for delays in delivery due to unforeseen circumstances such as adverse weather conditions, strikes, transport problems or events beyond its control.

You are obliged to accept any delivery of products, even if the delivery is received after the stated deadline. Failure to meet a delivery deadline does not give you any rights against Jeudi 13 Sàrl.

Delivery is made by DHL or La Poste.

Delivery charges are calculated according to your delivery address and the weight of your ordered products. The applicable rates are indicated during the order process and are automatically added to the total amount of the order.

ARTICLE 6 - CANCELLATION AND RETURNS

In accordance with the legal provisions in force, you have 10 working days following receipt of the package to return your order.

Returns must be in their original condition and complete (packaging, accessories, label, etc.). You are liable for Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.

You are responsible for return shipping costs.

If you exercise your right of return, Jeudi 13 Sàrl will reimburse the sums paid on receipt of the items concerned.

ARTICLE 7 - PAIEMENT

The fact of validating your order implies for you the obligation to pay the indicated price.

Payment is made by credit card using our secure payment systems.

The card is debited only when the order is dispatched. In the case of split deliveries, only the products shipped are debited.

We offer the following payment systems: credit and debit cards (Visa, Mastercard, Amex, ChinaUnionPay, Jcb, Diners, Discover, Electron, Maestro), Twint.

ARTICLE 8 - DISPONIBILITY

Our products are offered as long as they are visible on the site jeudi13.ch/e-shop and within the limits of available stocks. For products not in stock, our offers are subject to availability from our suppliers.

If a product is unavailable after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made.

Furthermore, the website jeudi13.ch/e-shop is not intended to sell its products in large quantities. Consequently, Jeudi 13 Sàrl reserves the right to refuse orders for 3 identical items.

ARTICLE 9 - GUARANTEES

All items offered on jeudi13.ch/e-shop are subject to the legal warranty against hidden defects. In the event of non-conformity of a product sold, it may be returned, exchanged or refunded.

All claims, requests for exchange or refund, must be made by e-mail to show-room@kikox.ch within 5 working days of delivery.

Products must be returned in their original condition and complete (packaging, accessories, label, etc.). Shipping costs will be reimbursed on the basis of the invoiced rate, and return costs will be reimbursed on presentation of receipts.

The provisions of this article do not prevent you from benefiting from the right of withdrawal provided for in article 6.

ARTICLE 10 - RESPONSABILITY

The products offered comply with current Swiss legislation. Jeudi 13 Sàrl cannot be held responsible in the event of non-compliance with the legislation of the country where the product is delivered.

Furthermore, the company Jeudi 13 Sàrl cannot be held responsible for damage resulting from misuse of the product purchased.

Finally, the company Jeudi 13 Sàrl cannot be held responsible for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.

ARTICLE 11 - LAW APPLICABLE IN THE EVENT OF A DISPUTE

The language of the present contract is French. The present conditions of sale are subject to Swiss law. In the event of a dispute, the Swiss courts shall have exclusive jurisdiction.

ARTICLE 12 - INTELLECTUAL PROPERTY

All elements of the site jeudi13.ch/e-shop are and remain the exclusive intellectual property of Jeudi 13 Sàrl.

No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express written consent of Jeudi 13 Sàrl.

ARTICLE 14 - ARCHIVING / PROOF

Jeudi 13 Sàrl will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the legal provisions of Switzerland.
